Terms in the Industry


Assessment – is the act or process of determining the value of a property or proportion thereof subject to tax, including the discovery, listing, classification and appraisal of properties.

Capital Gain Tax – The tax imposed on the profit derived from the sale of a capital asset.

Certificate of Occupancy – a document issued by the Building Official which certifies that a building complies with all building codes and is safe for use or habitation.

Clear Title or Clean Title – Title to property that is free from liens, defects or other encumbrances, except those which the buyer has agreed to accept, such as mortgage to be assumed, the ground lease of record, and the like; established title; title without clouds.

Common Areas – areas, such as entryways, foyers, pools, recreational facilities or the like, which are shared by the tenets or owners of property near by, commonly found in condominium or office spaces.

Condominium Ownership – An estate in real property consisting of an individual interest in an apartment or commercial unit, and an undivided common interest in the common areas such as the land, parking areas, elevators, stairways, and the like.

Deed – A written instrument by which a property owner “grantor” transfers to a “grantee” an ownership in real property.

Market Value – is the highest price in terms of money which a property can bring in a competitive and open market under all conditions that ensure fair sale, between a willing seller and a willing buyer.

Real Property – includes all the rights, interest, and benefits related to the ownership of real estate. Ownership of real estate is evidenced by a Certificate of Title, Free Patent or Tax Declaration in the absence of Certificate of Title.

Ordinary Asset – In the case of a taxpayer not engaged in the real estate business, real properties, whether land, building, or other improvements, which are used or being used or have been previously used in the trade or business of the taxpayer.

Capital Asset – is defined to include property of any kind held by an assessee, whether connected with their business or profession or not connected with their business or profession. It includes all kinds of property , movable or immovable, tangible or intangible, fixed or circulating.

Master Deed – A document used by condominium developers to record the project; its division into condominium ownership; and the grant of common areas to the condominium owners. Also called the declarations, the condominium declaration , or the declaration of condominium.
